Refund Policy

Due to the nature of our services:

• All deposits are non-refundable once a formal agreement is made and the project start date has been honored by Appilu. This includes work such as planning, consultation, and design preparation.

• Refunds will not be issued if the project is cancelled by the client after this point, regardless of how much of the project has been completed.

• If a project is terminated due to client non-responsiveness, breach of contract, or failure to provide required materials, no refund will be issued and the project may be closed at Appilu’s discretion.

Terms and Conditions

1. Ownership and Intellectual Property

​

• All website themes, templates, and designs created by Appilu are the intellectual property and trademark of Appilu, unless full ownership transfer is explicitly stated in writing.

• Clients are granted a non-exclusive license to use the final delivered website for their business purposes.

• Appilu reserves the right to include a subtle credit or trademark (e.g., “Designed by Appilu”) on all websites, which must not be removed without prior written consent.

• If a project is cancelled due to non-payment or client breach, Appilu retains all ownership of work completed up to that point and reserves the right to reuse any design elements in future projects.

2. Use of Materials

​

• Clients must provide all website content (text, logos, media, etc.) or confirm the right to use third-party materials.

• Appilu is not responsible for any copyright violations arising from client-provided materials.

3. Project Timeline and Delivery

​

• Timelines are discussed and agreed upon during onboarding but may shift based on client responsiveness and content delivery.

• Delays caused by the client (e.g., late content submission) may result in rescheduling or additional charges.

4. Payment Terms

​

• A non-refundable deposit (typically 50%) is required to begin the project.

• Final payment is due before handover or website launch.

• Failure to pay within agreed timeframes may result in project delays or termination.

5. Post-Launch Support

​

• Basic post-launch support is included based on the timeline stated in the selected website package.

• This support may include troubleshooting and minor tweaks.

• Once the support period ends, all further updates, content changes, or technical assistance will be billed separately.

• Appilu reserves the right to keep all designs that have already started as part of its intellectual property and may reuse them if a project is abandoned or unpaid.

6. Termination and Cancellation

Appilu reserves the right to terminate a project without refund for the following reasons:

• Non-responsiveness: No communication or content from the client for 14 consecutive days.

• Late or Non-Payment: Missed payment deadlines for deposits or final balances.
  In such cases, Appilu retains full rights to all designs and work completed to date and may reuse them in future projects.

• Breach of Agreement: Unauthorized use of Appilu’s materials or any breach of these terms.

• Inappropriate Conduct: Abusive, disrespectful, or unprofessional behavior toward Appilu staff or contractors.

• Illegal or Harmful Content: Requests for content that is unlawful, discriminatory, or violates Appilu’s ethical standards.

• Scope Changes Without Agreement: Repeated or unreasonable requests beyond the agreed scope without proper adjustments to cost or timelines.

Governing Law

This agreement and all business conducted with Appilu are governed by the laws of Jamaica. Any disputes shall be resolved in Jamaican courts or through mutually agreed arbitration.
